MKSystemz - Terms of Service and Acceptable Use Policy

Upon signing up for services through MKSystemz, all customers agree and must comply with this Acceptable Use Policy (AUP) and Terms of Service (TOS). This document is intended to provide a basic understanding of MKSystemz AUP and TOS.

MKSystemz does not actively monitor our customer’s activity and/or use of our services. However, MKSystemz reserves the right to remove any material that, in our sole discretion, may be illegal, subject us to liability, or violate our AUP. MKSystemz accepts no responsibility for data that is transmitted from or stored within our customers’ web hosting space.

ILLEGAL USE

MKSystemz services my not be used for illegal purposes. Illegal use examples include but are not limited to the following: Harm to minors in any way, threats of bodily harm or destruction of property, harassment of another in any way, fraudulent activity, forgery or impersonation, unsolicited email or SPAM, Email/News bombing, Email/Message forging, Usenet SPAM, Unauthorized access, Copyright or trademark infringement, collection of personal data about third parties without their knowledge or consent, Network disruptions and unfriendly activity, Net Send utility to send SPAM, Fraud, Infringement of Copyright, Patent, Trademark, Trade Secret or Intellectual Property Rights, Distribution of viruses, Inappropriate use of software, violation of AUP by a third party, Hosting IRC servers, IRC networks, Peer to Peer Software (file sharing) hosting or distribution of software, Pirated software, hacker programs, Warez sites, etc.

SECURITY

Violations of system or network security are prohibited. You may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. You may not attempt to gain another user’s account password. You may not log into or make use of a host server or server account you are not authorized to access. You may not attempt to interfere with the service of another user, host or network (Denial of service attacks). Customers who violate systems or network security may result in criminal and/or civil liability.

SERVER RESOURCES

Excessive use of server resources such as CPU time, memory, disk space and session time is prohibited. User must reduce level of use of server resources or pay additional fees to cover the resources used.

ACTIONS TAKEN BY MKSYSTEMZ

If an MKSystemz account is used to violate the AUP or TOS, we reserve the right to deactivate the customers account without notice. When MKSystemz becomes aware of a violation of its AUP or TOS, MKSystemz will investigate the violation and take necessary corrective action. MKSystemz does not give credits for services suspended during an investigation of a violation of its AUP or TOS. MKSystemz reserves the right to suspend or restrict the customer, until the situation is remedied. If the violation is a criminal offense, MKSystemz will notify the appropriate law enforcement authorities

MODIFICATION

MKSystemz reserves the rights to add, delete, or modify any provision of its Terms of Use or Acceptable Use Policy at any time without notice.
